LADY’S MILE HOLIDAY PARK
LEISURE FACILITIES MEMBERSHIP TERMS AND CONDITIONS

  1. Definitions

1.1 In these Terms and Conditions, “Lady’s Mile Holiday Park”, “we”, “us” or “the Centre” refers to the leisure facilities operated by Lady’s Mile Holiday Park Leisure Department.

1.2 “Facilities” means the gym, swimming pool, and any other leisure facilities, services, classes, equipment, amenities or areas we provide for member use from time to time. This includes any changing areas, corridors, reception/pool desk areas, and any associated spaces within the leisure building.

1.3 “Member” or “you” means any individual whose membership application has been accepted by us and who holds an active membership account in our membership system.

1.4 “Membership” means the membership type you purchase (including any minimum term), together with the rights of access and use that apply to that membership type.

1.5 “ClubRight” refers to the membership management system and mobile application used to manage memberships, payments and access.

1.6 “Manned hours” means the periods when Centre staff are present and available on site. “Unmanned hours” means the periods when staff are not present.

  1. Membership Acceptance and Access

2.1 All membership applications are subject to acceptance at the sole discretion of Lady’s Mile Holiday Park. We reserve the right to refuse any application and are not required to provide a reason for refusal.

2.2 We reserve the right to request verification or proof of information supplied during the joining process, including (but not limited to) name, address, email address, date of birth, and payment details. This may include requesting photographic identification or other evidence where reasonably required.

2.3 You must ensure that all information you provide to us remains accurate and up to date. If your details change (including email address, phone number, home address or payment details) you must update your details promptly through ClubRight or by contacting us.

2.4 If any information provided is found to be false, misleading, incomplete, or used fraudulently, we may cancel the membership, withdraw access to the Facilities, and recover any unpaid sums due. This includes, for example, joining under another person’s details, joining under an incorrect date of birth, or using a payment method without permission.

2.5 A legally binding contract is formed once we have accepted your application and your first payment has been successfully processed. By joining, you confirm that you have read, understood and agreed to these Terms and Conditions.

2.6 Access to the Facilities is provided through the ClubRight system. Members must present an active membership profile via the ClubRight App (QR code or digital membership profile) each time they enter the gym and/or when requested at the pool desk. Access cannot be granted without visible confirmation of an active membership entitlement.

2.7 There is no general alternative method of entry. Members are responsible for ensuring they can access and use the ClubRight App and that their device is charged and functioning when attending.

2.8 In limited circumstances, where a member is unable to use the access system due to technical issues, staff may provide alternative access during manned hours only, at staff discretion. This does not create any right to alternative access, and does not entitle the member to a reduction in fees.

2.9 Access credentials (including QR codes, logins, and any linked entry methods) are strictly personal to the named member and must not be shared. You must not allow another person to enter using your membership, whether deliberately or by negligence.

2.10 Any attempt to allow entry to non-members, or any misuse of access credentials, may result in immediate suspension of access while the matter is investigated.

2.11 Where misuse is confirmed, we reserve the right to cancel the membership and charge the member for any unauthorised entry at the current casual visit rate (or day pass rate) per person.

2.12 Age Restriction – Gym
Gym membership is strictly limited to individuals aged 18 years or over. By applying for gym membership, you confirm that you are at least 18 years of age at the time of joining. We reserve the right to request proof of age at any time. If it is identified that a member is under 18, gym access will be withdrawn and the membership will be cancelled in accordance with these Terms.
For the avoidance of doubt, this age restriction applies to gym access only. Swimming pool access is provided separately under its own terms and conditions and may be available to individuals under 18 in accordance with the pool policy.

  1. Membership Types, Pricing and Promotions

3.1 Membership categories, prices, minimum terms and payment methods are displayed at the point of joining and may vary from time to time. Members are responsible for selecting the membership type that best suits their needs.

3.2 The Centre may offer gym-only memberships, pool-only products, combined products, Paid in Full memberships, rolling monthly memberships, or other plans. The rights of access and use depend on the specific plan purchased.

3.3 All membership fees are payable regardless of usage. This means that if you choose not to attend, are unable to attend, or do not use the Facilities for any reason, membership fees remain payable for the duration of your membership contract.

3.4 Promotional pricing may be offered from time to time. Where a promotional rate is offered, it will apply only on the terms stated at the time of the offer and may be limited by time, availability, eligibility criteria, or membership type.

3.5 Promotional memberships may not be eligible for freezing, refunds or early cancellation unless specifically stated in the promotional offer.

3.6 We reserve the right to introduce, amend, withdraw, or replace membership categories, payment options and promotional offers at any time.

  1. Membership Fees, Payment Methods and Renewals

4.1 Members may be offered the option to pay:
a) Monthly by Direct Debit; or
b) Monthly by recurring card payment (including Stripe); or
c) Paid in Full for a fixed term at a discounted rate; or
d) Any other payment method offered from time to time.

4.2 Where a membership has a minimum term, the member agrees to pay the full minimum term regardless of usage or attendance. This applies even if the member stops attending, moves away, changes personal circumstances, or no longer wishes to use the Facilities.

4.3 Monthly memberships may continue automatically after any minimum term ends. This means that unless the member cancels correctly in accordance with these Terms, monthly payments will continue to be taken.

4.4 Members are responsible for ensuring that payment details remain valid and that sufficient funds are available to cover membership fees when due.

4.5 We reserve the right to review and increase membership fees periodically, including annually. Where a recurring payment is in place, we will provide at least 10 days’ notice of any increase.

4.6 If you do not wish to continue at a new price, you must cancel your membership in accordance with the cancellation process in Clause 5 before the new price takes effect.

4.7 Where a payment is collected through a third-party payment provider, the member remains responsible for ensuring payments are made correctly and on time.

  1. Cancellation and Changes by Members

5.1 Monthly Memberships (including rolling memberships)
Where your membership is monthly and does not have a minimum term, or where any minimum term has ended, you may cancel by emailing info@ladysmile.co.uk. Cancellation requests must be received at least 10 days before your next billing date. Cancellation will take effect at the end of your current paid month.

5.2 Minimum Term Memberships
Where your membership includes a minimum term (for example 3, 6 or 12 months), cancellation is not permitted until the minimum term has been completed, except where we agree to early cancellation in exceptional circumstances.

5.3 Paid in Full Memberships
Paid in Full memberships are offered at a discounted rate. As the discount is applied in exchange for upfront payment, Paid in Full memberships are not eligible for early cancellation, freezing, or refund, except where required by law or where we agree in exceptional circumstances at our discretion.

5.4 Discretionary Refund Calculation (Paid in Full)
If a discretionary refund is agreed, it will be calculated as:
The discounted price paid

(The standard non-discounted month-to-month rate multiplied by the number of months used)

a £20 administration fee.
If this calculation results in no remaining balance, no refund will be due.

5.5 Acceptable Grounds for Early Termination
Early termination may be considered for reasons such as serious illness, permanent incapacity, imprisonment, or death. Documentary evidence will be required. Approval remains at our discretion.

5.6 How to Cancel
All cancellations must be requested by the member in writing by email to info@ladysmile.co.uk. We do not accept cancellation requests by telephone, in person, or by post.

5.7 You must send cancellation requests from the email address registered on your membership account, or provide sufficient details for us to confirm identity. This is to protect members from unauthorised cancellation requests.

5.8 Cancelling a Direct Debit with your bank does not automatically cancel your membership contract. If you cancel your bank instruction without following the correct cancellation process, your membership may be suspended, but you may remain liable for payments due under any minimum term.

5.9 Any changes to membership type, payment method, or membership details must be requested by email to info@ladysmile.co.uk unless an alternative process is made available through ClubRight.

  1. Missed Payments and Arrears

6.1 If a recurring payment is missed for any reason (including “refer to payer”, insufficient funds, cancelled Direct Debit, or failed card payment), access to the Facilities will be suspended until the overdue amount has been paid.

6.2 The billing date will remain unchanged, and the member remains responsible for paying all amounts due, including any further payments that fall due while the account is in arrears.

6.3 Once arrears are paid, access will be restored, but there may be a delay of up to 48 hours for systems to update (longer if payment falls over a weekend or bank holiday). During this update period, access may only be granted during manned hours at staff discretion.

6.4 If two consecutive payments are missed, the member may be treated as being in breach of contract. Recovery action may begin for amounts owed, including any remaining minimum term liability.

6.5 If any amount remains unpaid for more than 30 days, the debt may be passed to a third-party collection agency. Any reasonable recovery costs incurred may be added to the outstanding balance where permitted by law.

6.6 Where an administration charge applies due to repeated missed payments, the member will be informed of the charge and the reason for it.

  1. Suspension or Termination by the Centre

7.1 We may suspend access or cancel membership immediately if, in our reasonable opinion:
a) A member breaches these Terms;
b) Payment remains overdue;
c) A member behaves in a way that is unsafe, abusive, threatening, disruptive, or inappropriate;
d) A member damages equipment or property;
e) A member misuses access credentials or permits unauthorised access;
f) A member’s conduct may bring the Centre into disrepute.

7.2 Suspension may be used as a temporary measure while an incident is investigated. During suspension, access will be removed and the member may be contacted for clarification.

7.3 Where membership is cancelled due to breach of these Terms, no refund will be provided.

7.4 If a member takes legal action against Lady’s Mile Holiday Park, this may be treated as a conflict of interest and membership may be cancelled. Any refund (if applicable) will be calculated in line with Clause 5.4.

  1. Health, Inductions and Unmanned Hours

8.1 By becoming a member, you confirm that you are in good health and not knowingly incapable of safely engaging in physical exercise.

8.2 You understand that exercise carries inherent risks, including the risk of injury. You accept that you use the Facilities at your own risk and are responsible for exercising within your own ability.

8.3 A complimentary induction is available for all new members. The induction is designed to explain the Facilities, safe use of equipment, and general gym rules.

8.4 You may choose to opt out of an induction. If you opt out, or fail to arrange and attend an induction, this will be treated as confirmation that you have declined. You agree that you will seek advice from staff during manned hours if you are unfamiliar with any equipment.

8.5 During unmanned hours, members must act responsibly, follow all safety signage, and in the event of an emergency call the emergency services and/or seek assistance as instructed on-site.

8.6 Members must not allow non-members to enter the Facilities during unmanned hours under any circumstances.

  1. Behaviour, Conduct and Use of the Facilities

9.1 Members must behave in a respectful and safe manner at all times while using the Facilities. This includes showing consideration to staff, other members, and visitors.

9.2 The following behaviour is not permitted and may result in immediate suspension or cancellation of membership:
a) Aggressive, abusive, threatening, discriminatory or harassing behaviour;
b) Bullying, intimidation, or unwanted attention towards staff or other members;
c) Deliberate damage to equipment, property, or the building;
d) Misuse of equipment or using equipment in a way that creates a risk to others;
e) Bringing alcohol, illegal drugs, or being under the influence of drugs or alcohol while using the Facilities;
f) Stealing, attempting theft, or suspected theft;
g) Allowing unauthorised access or sharing access credentials;
h) Ignoring safety signage, emergency instructions, or staff guidance.

9.3 Members must follow reasonable instructions given by staff, particularly where those instructions relate to safety, security, or the smooth running of the Facilities.

9.4 Members must use equipment as intended and in line with manufacturer guidance. If you are unsure how to use equipment safely, you must seek advice from staff during manned hours.

9.5 Appropriate clothing and footwear must be worn at all times in the gym. Clothing must be clean, suitable for exercise, and must not pose a safety risk.

9.6 For hygiene and safety reasons, members must use a towel where appropriate and must wipe down equipment after use using the cleaning materials provided.

9.7 Filming, photography, and recording within the Facilities is not permitted unless prior permission has been granted by Centre management. This is to protect the privacy and comfort of all users.

9.8 We reserve the right to refuse entry, suspend access, or cancel membership where we reasonably believe a member’s behaviour is unsafe, inappropriate, or likely to negatively impact other users or staff.

  1. Personal Training and Commercial Activity

10.1 Membership permits personal use of the Facilities only. Members may not carry out personal training, coaching, instruction, or any form of paid or unpaid commercial activity within the Facilities without prior written approval from Centre management.

10.2 This includes, but is not limited to:
a) Training or instructing other members in exchange for payment, gifts, or any form of benefit;
b) Advertising services to other members or soliciting clients;
c) Filming content for commercial use or promotional purposes;
d) Operating fitness classes, group sessions, or structured programmes for others.

10.3 Any member found to be conducting unauthorised personal training or commercial activity may have their membership suspended or cancelled without refund.

10.4 Lady’s Mile Holiday Park reserves the right to approve, refuse, or withdraw permission for any personal training or commercial activity at its discretion.

  1. Limitation of Liability

11.1 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded.

11.2 Subject to clause 11.1, Lady’s Mile Holiday Park will not be liable for any indirect or consequential loss, damage, costs or expenses.

11.3 We do not accept liability for loss, theft or damage to personal belongings brought onto the premises. Members are advised not to bring valuables into the Facilities and to store belongings responsibly.

11.4 Lost property will be retained for up to one month. Items not collected within this period may be disposed of, donated, or recycled.

  1. Facilities, Maintenance and Changes

12.1 We reserve the right to make reasonable changes to the Facilities, equipment, services, layout, and operational arrangements without notice where necessary for safety, maintenance, improvement, or operational reasons.

12.2 The Facilities, or parts of them, may be closed temporarily for essential maintenance, repairs, health and safety reasons, staffing issues, special events, private hire, or circumstances beyond our control.

12.3 No refunds will be provided for closures lasting eight weeks or less.

12.4 Where possible, we will aim to give reasonable notice of planned closures, however this may not always be possible in emergency situations.

12.5 Where a member is unable to use the access system, alternative access may be provided during manned hours at staff discretion. This does not entitle the member to any reduction in fees.

  1. Opening Hours

13.1 Opening hours and manned hours are available on request and may also be displayed on the website, within the Facilities, or through the Lady’s Mile Holiday Park app.

13.2 Hours may be extended, reduced, or amended at our discretion due to seasonal changes, staffing, maintenance, or operational requirements.

13.3 We will aim to provide reasonable notice of changes where practical.

  1. Swimming Pool Access

14.1 Swimming pool access is available to customers and members who hold an active pool entitlement. Pool access is managed separately and may be subject to separate pricing and separate terms and conditions.

14.2 To access the pool, users must present an active membership profile via the ClubRight App at the pool desk each time they visit. Entry cannot be granted without visible confirmation of an active pool entitlement.

14.3 Outside of designated holiday periods, advance booking may not be required. Access remains subject to operational availability, capacity limits, health and safety requirements, and staffing levels.

14.4 During holiday periods, booking systems may be introduced to manage demand. Bookings may be made through the Lady’s Mile Holiday Park mobile application where available. A booking does not guarantee entry if capacity or safety limits are reached.

14.5 We reserve the right to close or restrict the swimming pool at any time for maintenance, safety reasons, staffing, events, private hire, or operational requirements. Where possible, we will provide reasonable notice of planned closures.

14.6 Pool passes may be made available from time to time and are subject to the conditions stated at the time of sale.

  1. Internet and WiFi Acceptable Use

15.1 Wired and wireless internet access may be provided as a courtesy. Use is at your own risk and is provided on an “as-is” basis.

15.2 Lady’s Mile Holiday Park does not guarantee availability, speed, reliability, or security of the network and is not responsible for loss of data, service interruption, or security issues experienced while using the network.

15.3 Users must comply with all applicable laws and must not use the network for unlawful, malicious, fraudulent, disruptive or abusive purposes.

15.4 Users must not install, connect, or use any device or software that interferes with the network or restricts other users from accessing the service.

15.5 We reserve the right to disconnect any user at any time where we consider it necessary.

  1. Fire and Emergency Procedures

16.1 If you discover a fire, activate the nearest fire alarm immediately and alert staff if possible.

16.2 If the fire alarm sounds, you must leave the building immediately using the nearest available exit or as directed by staff.

16.3 Do not stop to collect personal belongings.

16.4 Proceed to the designated assembly point (usually the car park) and remain there until authorised to return.

  1. Data Protection and Personal Information

17.1 We process personal and transactional information (including name, address, email address, phone number and payment records) for the purpose of administering memberships, providing services, and managing access.

17.2 While your membership is active, the lawful basis for processing is Contract. Where membership ends, we may retain necessary records under Legitimate Business Interest and/or legal compliance requirements.

17.3 We take reasonable steps to protect personal data. However, we cannot be responsible for unauthorised access by third parties unless caused by our negligence.

  1. Unauthorised Access to Payment Information

18.1 Unless caused by our negligence, we will not be liable for losses resulting from unauthorised access to card or payment information transmitted by you during the joining or payment process.

18.2 It is your responsibility to ensure your payment details are kept secure and not shared, and to ensure you have permission to use any card or bank account used to pay for membership.

  1. Centre Rules and Updates

19.1 In addition to these Terms and Conditions, members must follow all reasonable Centre rules, notices and safety guidance displayed within the Facilities or communicated by staff.

19.2 Centre rules may be updated from time to time for operational, safety, or customer experience reasons. Updated rules will apply once displayed in the Facilities and/or communicated to members.

19.3 Where a member repeatedly breaches Centre rules, we may suspend access or cancel membership in accordance with Clause 7.

  1. Third Party Rights

A person who is not a party to these Terms and Conditions has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of them.
